AGREEMENT BETWEEN CANDIDATE FOR U.S. OR CANADIAN
INDEPENDENT SCHOOL PLACEMENT AND SEARCH ASSOCIATES

PREAMBLE:
Search Associates serves both schools looking for appropriate educators AND candidates seeking suitable professional positions. All three parties (schools, candidates and Search Associates) must operate with honesty and integrity and act in good faith while, obviously, working towards their own best interests. In order to serve you, Search Associates must have your understanding of and commitment to the following:

1. If I receive and accept a WRITTEN OR VERBAL OFFER OF CONTRACT from a school through the Search Associates database or by any other contact facilitated by Search Associates, that acceptance is a binding commitment.

2. I agree that I will carefully consider all school offers that are presented with a reasonable and fair time line for acceptance, and will not accept one unless I fully intend to honor my commitment. If I subsequently fail to honor a verbal or written agreement, letter of intent, or contract, then I agree to pay Search Associates the 6% of first year salary ordinarily paid by the school, plus any additional cost of legal action to collect that 6%,.

3. If I contact any school using the Search Associates website data base, or if I contact any school based on information received in the Search Associates daily email, I will identify myself to the school as a Search Associates candidate. If I communicate by email, I will send a copy to hjpackard@gmail.com. and also to any other associate with whom I may be registered.

4. If I find an opening by visiting the vacancy pages on the Search Associates web site, and subsequently contact the school and am hired by that school, I agree that this constitutes a Search Associates placement. Likewise, if a school visits my application on the Search Associates website, and subsequently contacts and hires me, that constitutes a Search Associates placement.

PLEASE NOTE THAT ALL ACTIVITY ON OUR WEBSITE IS AUTOMATICALLY RECORDED ELECTRONICALLY FOR OUR PERMANENT RECORDS.

5. I agree that I will not give my password or user name to any other person, and I will not share information from the website with other persons. If I do, I agree that I may be liable for payment of the 6 % placement fee if such person should use this information to obtain employment.

6. I agree to notify Search Associates WITHIN 7 DAYS OR SOONER of accepting any verbal or written offer of employment. I will also provide Search Associates with the name and location of the school which hires me, whether or not the offer came through Search Associates contacts –in order to spare other schools and Search Associates taking time with my candidacy.

7. I agree that promptly after accepting a verbal or written school offer, I will log on to my web application form and indicate that I am no longer available. I understand that my application will only be active until I have found a position, or for a maximum of 3 years, whichever comes first.

8. I understand that for my application to stay active, I must frequently update my status and contact information. If I do not do so, or do not respond to repeated attempts by Search Associates to reach me, my application may be deleted and must be resubmitted. If I discontinue searching for a position, my access to vacancy information will be deactivated until such time as I notify Search Associates that I have resumed an active search.

9. I understand that my file and its contents are the property of Search Associates and will remain confidential except for what Search Associates releases to school administrators who are considering me for a position.

10. I waive my right of access to any and all confidential letters or evaluation forms in my file, and will never make any attempt, or ask other persons to make an attempt, to determine the contents of such evaluations.

11. By submitting my application and signing, dating and sending this agreement, I certify that all statements I have made on this application are complete, true, and correct to the best of my knowledge. By submitting this application and agreement I authorize investigation of all statements on the application.

12. I understand that if I entered false information on my application, or if I violate application or agreement provisions, Search Associates has the right to drop me from its register of candidates and deny me access to its website. I further understand that inclusion of false information may be deemed due cause for a school which has hired me to consider my contract null and void and hold me liable to reimburse the school for all expenses incurred in my hiring.

I HEREBY STATE THAT I HAVE READ CAREFULLY ALL PROVISIONS OF THE APPLICATION AND AGREEMENT, THAT I UNDERSTAND THEM, AND AGREE TO ABIDE BY THEM.

(IF YOU HAVE REGISTERED WITH AN ASSOCIATE OTHER THAN DR. PACKARD, PLEASE MAIL OR FAX A COPY OF THIS SIGNED AGREEMENT TO THAT ASSOCIATE.
